dave, when you say I'm wrong, you're saying five (5) justices of the Supreme Court are wrong. The decision has been made by the Supreme Court. I described the reasoning behind the decision. The fact that a minority opinion also exists is interesting, but it does NOT invalidate the majority decision. The majority decision is that the individual mandate of the Affordable Care Act is constitutional and therefore is the law of the land.

dave, the Supreme Court has decided that that reasoning is wrong.
Again, according to five (5) justices of the Supreme Court, the penalty is a tax on those who choose to go without health insurance. It is constitutional by the arguments given, and it is now the law of the land.
My opinion is that Roberts went that way to set up the conservatives who will want to tax things they don't like. e.g. not serving in the military in time of war, or not voting. Wait... conservatives don't want us to vote.
